1. Who we are

2. Scope

These terms govern all offers, orders and contracts concluded through this website between us and you. By placing an order you confirm that you have read and accepted these terms. If you are a consumer, nothing in these terms limits your mandatory rights under Belgian and EU consumer law.

3. Products

Our rugs are hand-woven, one-of-a-kind pieces. Small variations in size, knot density, pile height and colour are inherent to handmade work and are not defects. Photographs are taken as faithfully as possible, but the colour rendering of your screen may differ slightly from the actual item.

4. Prices and taxes

All prices are shown in euro and include Belgian VAT at 21%. Where you select another display currency, the amount shown is an indicative conversion; the transaction is settled in the currency confirmed at checkout. Prices may change at any time, but the price displayed at the moment your order is confirmed is the price that applies to that order.

For deliveries outside the European Union, import duties and local taxes may be charged by the destination country. These are not included in our prices and are payable by the recipient.

5. Placing an order

Products displayed on the website are an invitation to order, not a binding offer. A contract is concluded only when we send you an order confirmation by email. We may refuse an order — for example if an item is no longer available, if the price was displayed incorrectly due to an obvious error, or if payment cannot be authorised — in which case any amount already paid is refunded in full.

6. Payment

Accepted payment methods are shown at checkout. Card payments are processed by our payment service provider over an encrypted connection; we never store your full card details on our own servers. Ownership of the goods passes to you once payment has been received in full.

7. Delivery

We deliver to the address you provide at checkout. Standard shipping is free of charge. Orders placed before 14:00 (CET) on a working day are normally dispatched the same day, and delivery usually takes 1–3 working days; a tracking number is sent to you on dispatch. Unless otherwise agreed, we deliver no later than 30 jours after the contract is concluded. If we fail to deliver in time, you may set an additional reasonable period and, if that too passes, terminate the contract and receive a full refund.

The risk of loss or damage passes to you only when you, or a third party designated by you, take physical possession of the goods.

8. Right of withdrawal and returns

As a consumer you may withdraw from your purchase within 14 calendar days of receipt without giving a reason, and we voluntarily extend this to 30 days. The full procedure, the model withdrawal form and the refund terms are set out in our Returns & Refunds policy, which forms part of these terms.

9. Legal guarantee of conformity

Consumers benefit from the legal guarantee of conformity of two years from delivery under Belgian law. If an item is not in conformity with the contract, you are entitled to have it repaired or replaced free of charge and, where that is impossible or disproportionate, to an appropriate price reduction or termination of the contract. Please report any lack of conformity within two months of discovering it.

10. Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded. Subject to that, we are not liable for indirect or consequential loss, and our total liability in respect of an order is limited to the amount paid for that order.

11. Intellectual property

All content on this website — including designs, photographs, text and logos — belongs to us or our licensors and may not be reproduced, distributed or used commercially without our prior written consent.

12. Personal data

We process personal data in accordance with the GDPR, as described in our Politique de confidentialité.

13. Complaints, applicable law and jurisdiction

Please send any complaint to info@yamilcraft.com. You may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr or contact the Belgian Consumer Mediation Service.

These terms are governed by Belgian law. Consumers retain the protection of the mandatory provisions of the law of their country of habitual residence and may bring proceedings before the courts of that country. For all other customers, the courts of Brussels have exclusive jurisdiction.
